Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and aiFoundRE LLC (“aiFoundRE,” “we,” or “us”). By purchasing a FoundScore audit, subscribing to any tier, or otherwise using our services, you agree to these Terms. If you're using the service on behalf of a brokerage or team, you represent that you have authority to bind that organization.

ai{Found}RE provides AI visibility audits, monitoring, coaching, and content services for real estate professionals. Specifically:

• —FoundScore — a 100-point audit of how visible you are across AI platforms, delivered as a scored report with a gap analysis and action plan
• —Monitoring — ongoing tracking of your visibility score over time
• —Coaching — group or individual sessions to help you act on your audit findings
• —Done-With-You / Done-For-You — content system build-out and execution, depending on your tier

We reserve the right to modify, improve, or discontinue features of the service with reasonable notice. Material changes to paid tiers will be communicated by email.

This is important: we audit and measure your AI visibility — we do not control it.

• —We do not guarantee that any AI platform will recommend you, mention you, or increase your visibility score
• —AI platform behavior changes frequently and is outside our control
• —FoundScores reflect conditions at the time of the audit — they are not permanent assessments
• —Our action plans represent best-practice recommendations, not guaranteed outcomes
• —We do not guarantee lead generation, commissions, or business results of any kind

Our job is to measure accurately, report honestly, and give you the best possible roadmap. Execution and outcomes are yours.

One-time audit fees are charged at purchase. Subscription tiers are billed monthly in advance. All payments are processed by Stripe.

• —Subscriptions renew automatically on your billing date unless cancelled
• —You can cancel anytime — cancellation takes effect at the end of your current billing period, with no further charges
• —We do not offer refunds on completed audits or past subscription months
• —If a payment fails, we will attempt to collect for up to 7 days before suspending your account
• —Prices are subject to change with 30 days notice to active subscribers

You are responsible for providing accurate information during onboarding. Inaccurate market or profile data will directly affect the quality of your audit results.

Your audit results, FoundScore history, and reports are yours. You can request a copy of your data at any time. See our Privacy Policy for full details on how we store and protect your data.

By using ai{Found}RE, you agree not to:

• —Resell, sublicense, or redistribute our reports or methodology without written permission
• —Use audit results to misrepresent your visibility to clients or employers
• —Attempt to reverse-engineer, scrape, or copy the FoundScore methodology
• —Use the service to audit competitors without their consent
• —Submit false information during onboarding to manipulate your score
• —Use the service in any way that violates applicable law or NAR / state real estate regulations

The FoundScore methodology, scoring rubric, report templates, and all associated content are owned by aiFoundRE LLC. Your individual audit results belong to you. You may share your FoundScore and report for personal marketing purposes — for example, displaying your score on your website or in marketing materials — but may not represent them as created by you or reproduce the full report in a competing product.

To the maximum extent permitted by law, aiFoundRE LLC's total liability to you for any claim arising from these Terms or your use of the service is limited to the amount you paid us in the 3 months preceding the claim.

We are not liable for indirect, incidental, special, or consequential damages — including lost commissions, lost leads, or business interruption — even if we were advised of the possibility of such damages.

Some states do not allow certain liability limitations. Where those laws apply, our liability is limited to the fullest extent permitted.

You agree to indemnify and hold harmless aiFoundRE LLC and its members, employees, and contractors from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or any false information you provided during onboarding.

Either party may terminate the relationship at any time. You may cancel your subscription as described in Section 4. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law — with notice where practicable.

On termination, your access to the service ends. Your data is handled per our Privacy Policy.

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Essex County, New Jersey, and you consent to personal jurisdiction there.

We may update these Terms as the service evolves. We will notify active subscribers by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
